In a recent case here in Massachusetts, the Suffolk Superior Court ruled that the restaurant owner may decide how to allocate the pooled tips received. L’Espalier owner Frank McClelland used a formula to allocate pooled tips, and two of his waiters disagreed and challenged his custom. The court sided with the restaurant owner, as more staff than just the server had been associated with the meal.
