POOL IS YOURS TO SWIM IN
In
a recent case here in Massachusetts, the Suffolk Superior
Court ruled that the restaurant owner may decide how to allocate
the pooled tips received. L’Espalier owner Frank McClelland
used a formula to allocate pooled tips, and two of his waiters
disagreed and challenged his custom. The court sided with
the restaurant owner, as more staff than just the server had
